Terms of use and privacy policy
Just in time staffing AG, Uetlibergstrasse 134, 8045 Zürich, Switzerland ("we", "us" or "JITS") operates the Adia online platform via which candidates seeking temporary jobs (“candidates”) and clients seeking temporary staff ("clients") are brought together (candidates and clients jointly referred to as "users", "you", "your"). JITS offers its services via the website https://adia.com ("Adia website") and its App ("Adia App") (Adia website and Adia App hereinafter jointly referred to as the "Adia online platform" or "Adia").
JITS has all licences required for the provision of its services in Switzerland, in particular a licence to contract staff issued by the Office for Economy and Labour of the Canton of Zurich.
The following terms of use (A. Terms of use) and privacy policy (B. Privacy policy) govern the use of the Adia online platform by users.
Use of the Adia online platform is free of charge for all users.
A. Terms of use
1. Scope of application
The following terms of use comprise general terms and conditions of use agreed between users and JITS (hereinafter referred to as the “terms of use”). The terms of use govern access to and use of the Adia online platform.
By downloading, installing, using or accessing the Adia online platform, you the user agree to the terms of use in the respective version applicable at the time of downloading, installation, use of or access to the Adia online platform. The current version of the terms of use can be found in the Adia App under “Settings -> Terms of use” and be retrieved from the following link: https://www.adia.rocks/terms-of-use. You can also request the current version of the terms of use from us at any time (cf. C. Contact details).
The privacy policy of JITS under B. Privacy policy (the “privacy policy”) forms an integral part of these terms of use. The current version of the privacy policy can be found in the Adia App under “Settings -> Privacy policy” and be retrieved from the following link: https://www.adia.rocks/privacy-policy. You can also request the current version of the privacy policy from us at any time (cf. C. Contact details).
The relationship between users and JITS for all services provided by JITS is exclusively governed by these terms of use and the privacy policy. Deviating or conflicting terms and conditions of business do not apply. Insofar as these terms of use do not contain any provisions of their own, the terms of use of the Google Play Store (“Google Play Terms of Service”) or Apple iTunes Store (“Apple Website Terms of Use”) applicable at the time of installation, use of or access to the Adia App apply with respect to the Adia App at the time of downloading, installation, use of or access to the Adia App. The current Google Play Terms of Service can be retrieved from https://play.google.com/intl/de_ch/about/play-terms/ in the version applicable locally for you. The current Apple Website Terms of Use can be retrieved from https://www.apple.com/legal/internet-services/itunes/chde/terms.html in the version applicable locally for you.
2. Registration
2.1. Registration as a candidate
Persons seeking temporary jobs need to register as candidates. Only natural persons of legal age who are resident in Switzerland may register as candidates. By registering, candidates confirm that they have the necessary documents and permits to be allowed to work in Switzerland. Candidates who are not Swiss nationals may only register if they are citizens of one of the following EU/EFTA countries, in possession of a valid work permit and resident in Switzerland or one of the following EU/EFTA countries: Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden or United Kingdom of Great Britain and Northern Ireland.
The details provided by candidates on registration must be true. Candidates must be able to produce all of the documents required from them on registration and JITS is entitled at any time to demand that missing or expired documents be submitted at a later date. Should candidates fail to meet such a requirement promptly, JITS is entitled to block such candidates’ access to the Adia online platform and terminate any existing contracts with such candidates with immediate effect. All other rights of JITS in the event of missing or incorrect details, in particular claims for damages, remain reserved.
2.2. Registration as a client
Persons seeking temporary staff need to register as clients. Only natural persons of legal age who are resident in Switzerland and legal entities and partnerships domiciled in Switzerland may register as clients. By registering, clients confirm that they have all necessary permits for their business operations. They furthermore undertake to comply with all labour provisions under public law as well as all provisions from collective employment agreements applicable to their businesses. Persons carrying out client registration for a legal entity confirm that they are authorised to represent said legal entity.
The details provided by clients on registration must be true. Clients must be able to produce all of the documents required from them on registration and JITS is entitled at any time to demand that missing or expired documents be submitted at a later date. Should clients fail to meet such a requirement promptly, JITS is entitled to block such clients’ access to the Adia online platform and terminate any existing contracts with such clients with immediate effect. All other rights of JITS in the event of missing or incorrect details, in particular claims for damages, remain reserved.
3. Use of the Adia online platform
3.1. General obligations of users
Users are obliged to use the Adia online platform in accordance with these terms of use.
In particular, you may not use the online platform if you are not of age or not resident in Switzerland or one of the aforementioned EU/EFTA countries.
Users are required to safeguard the security of their accounts and to notify JITS immediately if they become aware of any unauthorised use. The user names and passwords for Adia assigned to users on registration must be saved carefully and not shared with third parties. JITS must be notified immediately if user names and passwords fall into the hands of third parties. Users may not disclose their login details (in particular the password) for their Google Play Store or Apple iTunes Store account to third parties without the prior written consent of JITS. Users bear full responsibility for all actions of unauthorised third parties as if they were their own.
Use of the Adia online platform is free of charge. However, users acknowledge that costs can be incurred through the use of the Adia online platform (such as data tariffs of their mobile or network provider). Users are personally responsible for all costs, fees and duties associated with the use of the Adia online platform.
Users are obliged to provide all details requested on registration truthfully and in full and to submit all requested documentation. All changes concerning the details provided must be updated immediately via Adia. Every user is also obliged to notify JITS of all changes that could impact their entitlement to participate in the contracting of staff in Switzerland, in particular with regard to expired work permits or operating licences. JITS may review the details at any time and request necessary documentation. If users are found not to have correctly complied with these obligations in full, JITS shall be entitled to block such users’ access to Adia and terminate all existing contracts with immediate effect.
Users confirm and undertake voluntarily and explicitly to bear sole and exclusive responsibility for the use of Adia. Users may not act in any way that jeopardises the reputation, interests or rights of JITS or those of a company affiliated with JITS or which damages or impairs the Adia online platform or could impede normal usage by other users in any way whatsoever.
Users may not avail themselves of the services offered by JITS and the Adia online platform in any manner that is prohibited, unlawful or violates the terms of use. Should such use be discovered, JITS reserves the right to deactivate the account of such users and bar them from using the Adia online platform. In this case, such users shall not be permitted to create a new account without the written consent of JITS.
3.2. Contracts with candidates
As soon as a candidate is hired for an initial assignment with a client, two contract documents are generated via Adia: (i) a framework employment contract defining the rights and obligations between JITS and the candidate for the first and all subsequent assignments with all clients, and (ii) an assignment contract setting out the conditions of the first assignment. A new assignment contract is then generated for each subsequent assignment with the same or a different client.
These contract documents are automatically created by Adia and signed electronically by JITS. The candidate undertakes to legally sign all contract documents. This can take place either by means of: (I) an electronic signature satisfying the requirements of Swiss law or (ii) signing the printed contract documents and returning them to JITS. At the request of JITS, the candidate undertakes to supply them with a legally signed copy of each original contract document.
3.3. Contracts with clients
Each time a client accepts a candidate for temporary jobs, Adia generates a hire contract setting out the conditions of the applicable assignment. The General Conditions for the Contracting of Staff of JITS are also issued together with the initial hire contract. The General Conditions for the Contracting of Staff form the basis of each individual hire contract and are an integral part of each hire contract.
These contract documents are automatically created by Adia and signed electronically by JITS. The client undertakes to legally sign all contract documents. This can take place either by means of: (I) an electronic signature satisfying the requirements of Swiss law or (ii) signing the printed contract documents and returning them to JITS. At the request of JITS, the client undertakes to supply them with a legally signed copy of each original contract document.
3.4. Time recording
Adia provides a time recording facility for each of the candidate’s assignments. As soon as candidates arrive at their agreed place of work, they can log into the assignment via Adia. Before leaving the place of work again, candidates must log out from the assignment via Adia. Clients can check this information concerning logging into and out of the assignment and subsequently confirm or correct the information provided by the candidate.
3.5. Assessment after end of assignment
Both the candidate and the client are asked to assess each other at the end of each assignment. All assessments must be carried out carefully, conscientiously and in accordance with the criteria specified by Adia. JITS reserves the right to delete any type of assessment that does not meet its requirements. JITS is likewise entitled to amend the assessment criteria at any time. It then transfers existing assessments to the new criteria at its discretion.
4. Blocking access to Adia
JITS is entitled to block candidates’ access to Adia if they violate their obligations from these terms of use. JITS is likewise entitled to exclude candidates from Adia who violate their obligations towards clients, in particular in the event of unexcused failure to show up for an assignment with a client or non-compliance with a client’s instructions. JITS can also deny candidates access to Adia if their assessment falls below the defined minimum level.
JITS is entitled to block clients’ access to Adia if they violate their obligations from these terms of use. JITS is in particular entitled to exclude clients from Adia if they fail to pay the outstanding accounts of JITS derived from the hire contracts on time, bankruptcy proceedings are initiated against them or they file for bankruptcy protection, or if there is any other legitimate reason to assume their impending insolvency. JITS is likewise entitled to exclude clients from Adia that violate their obligations towards candidates. JITS can also deny clients access to Adia if their assessment falls below the defined minimum level.
5. Security
JITS deploys appropriate security measures suitable for detecting viruses. Nonetheless, each user needs to be aware that the security measures available for computer systems on the Internet cannot offer complete protection. JITS cannot guarantee that there are no viruses or other elements circulating that could cause changes to the computer systems (hardware and software) of users or to the data stored on their systems.
6. Intellectual property rights
All contents of the Adia online platform and its associated applications and websites, including but not limited to source code, layout, structure, images, photos, illustrations, texts and other materials, are the property of JITS or have been licensed for use by JITS. All trademark rights, copyrights, patent rights, rights to know-how and other intellectual property rights belong to JITS or its licensors.
Users acknowledge that they do not acquire any kind of intellectual property rights, including but not limited to copyrights, brands, patents or know-how, to the Adia online platform and to the contents and services provided by JITS. JITS merely grants users a non-exclusive, non-transferable and non-sublicensable right to access the Adia online platform on their devices (in particular mobile devices, PCs and tablets) and use it in accordance with these terms of use.
JITS reserves the right to serve notice in writing (e.g. by e-mail, app message or text message) on the Adia App and its services at any time, subject to at least 30 (thirty) days' notice. Upon termination, regardless of the reason, the right granted to users in accordance with these terms of use automatically ceases. JITS supports users at their request in downloading their data on the Adia online platform, e.g. in the Adia App, and storing them on a suitable data device. Should the costs incurred from such a request prove exceptionally high in comparison to similar data migrations, JITS shall be entitled to appropriate compensation.
Users undertake to respect all intellectual property rights of JITS and third parties at all times. Users are prohibited from altering, copying, sending, forwarding, exhibiting, presenting, reciting, reproducing, publishing, licensing, transferring and/or preparing derivative works from or otherwise making use of contents of the Adia online platform for commercial or public purposes for themselves or for third parties.
Users are not permitted to access the source code of the Adia App. Furthermore ,users may not carry out any reverse engineering, decompiling or disassembly of the source code, nor may they decode, modify or edit it unless this is permitted by prevailing law, nor may they manufacture any derived software on the basis of the source code in order to produce, transfer and/or sell derivative works or to visualise Adia (or parts thereof) with technical aids or functions (e.g. “framing”).
Users grant JITS an unlimited, non-exclusive, global, transferable and sublicensable right of use, reproduction, dissemination, creation of derivative works and presentation of information (and its contents) with respect to all information and contents provided by them via Adia for the business and other purposes set out in B. Privacy policy of JITS and its affiliated companies for the duration of the business relationship between said users and JITS.
Users declare that they have obtained all necessary third-party rights in connection with the contents they upload.
7. Links and linking
Links can be displayed to other websites that are operated by third parties not affiliated with JITS via Adia. The inclusion of such links to third-party websites does not entail any implicit approval of these sites by JITS. JITS has not reviewed all the external sites linked with its website and is not responsible for the content or accuracy of these sites or of other sites linked with the website. The use of links to access external or third-party sites takes place at users’ own risk.
8. Disclaimer of warranty and limitation of liability of JITS
Subject to mandatory statutory provisions, all assurances, warranties and guarantees concerning the online platform offered by JITS are hereby expressly excluded.
Use of the Adia online platform and its contents takes place at the user’s own risk. JITS is not responsible for the use of the online platform. The telecommunications service provider of the mobile and/or Internet subscription chosen by the user is responsible for transmission of the information via a telecommunications installation and all complaints and claims of the user in this connection must be directed to said user’s telecommunications service provider.
The online platform is provided “in its present state” (current state) and “subject to availability” without any guarantee of any kind. JITS in particular offers no guarantee or assurance i) that the Adia online platform and its contents are correct, complete, error-free and reliable or that their use does not violate any third-party rights; ii) that the functional aspects of the Adia online platform and its contents are free of error or that the servers via which Adia and its contents are provided are free of viruses or other harmful components; iii) that the Adia online platform is flawlessly usable, intercompatible with other systems and available at all times; iv) that Adia and the services offered via it will also remain available without restriction in the future.
JITS reserves the right to carry out changes to the platform and range of services or to discontinue them partially or entirely at any time and without prior notice. Users have no entitlement to the continuation of the Adia online platform and services of JITS. The availability of the online platform can also be interrupted at any time, for instance for maintenance, repair and improvement purposes.
To the extent permitted by law, JITS disclaims all liability for damages incurred as a result of or in connection with the use of the Adia online platform or its contents, regardless of whether these are direct, indirect, consequential or other damages.
9. Liability of and indemnification by users
Should a third party, in particular other users, authorities etc., lodge claims against JITS arising from or in connection with the use of the Adia online platform by a user, said user shall release JITS from all liability, damages, losses and expenses (including court costs and reasonable attorney’s fees) and indemnify JITS in full, including reasonable attorney’s fees and court costs).
10. Terms of use required due to the Google Play Terms of Service and/or Apple Website Terms of Use
The provisions in this clause 10 do not entail any further obligations of JITS to users that do not already arise from other provisions in these terms of use.
10.1. Google Play Terms of Service
Notwithstanding any provisions to the contrary in these terms of use: i) users have no further rights to the Adia App or use of the Adia App other than those derived from the Google Play Terms of Service; ii) users may not make use of the Adia App in any way that contravenes the Google Play Terms of Service; and iii) users may only make use of the Adia App with products permitted by the Google Play Terms of Service.
Both users and JITS acknowledge and agree that i) these terms of use constitute an agreement between the user and JITS; ii) Google LLC is not a party to these terms of use; iii) only JITS, and not Google LLC, is exclusively responsible for the Adia App in accordance with these terms of use; iv) Google LLC has no obligation to maintain or offer support for the Adia App; v) Google LLC bears no liability for the non-compliance of the Adia App with any applicable guarantees or warranties and JITS is exclusively responsible in accordance with these terms of use for any claims, losses, damages, responsibilities, costs or expenses resulting from the failure to uphold any applicable guarantees for the App; vi) JITS and not Google LLC is responsible in accordance with these terms of use for any responsibilities pertaining to the Adia App or its access and use, including but not limited to: a) claims from product liability; b) claims resulting from the fact that the Adia App does not comply with the applicable legal and regulatory provisions; and c) claims under consumer protection law and similar statutory provisions; vii) in the event of the assertion of claims by third parties due to the alleged violation of intellectual property rights by the Adia App or through the disposal over and use of the Adia App by a user, only JITS and not Google LLC is exclusively responsible in accordance with these terms of use for the investigation, defence, dispute resolution through settlement and discharge of such violation claims; and viii) Google LLC and its subsidiaries are third parties to these terms of use and by consenting to these terms of use, users grant Google LLC and its subsidiaries the right to enforce these terms of use against such users as third parties benefiting from these terms of use.
Users represent and warrant that: i) they are not in a country affected by a US government embargo or that is ranked by the US government as a country that supports terrorists (terrorist supporting country); and ii) they are not included on a US government list of prohibited or restricted parties.
10.2. Apple Website Terms of Use
Notwithstanding provisions to the contrary in these terms of use, users have no rights to use the Adia App that exceed the Apple Website Terms of Use. Users may not use the Adia App in any way that contravenes the Apple Website Terms of Use and may only make use of the Adia App on an Apple product with iOS that they own or control as permitted by the Apple Website Terms of Use.
Both users and JITS each acknowledge and agree that: i) these terms of use are concluded between the user and JITS and not with Apple Inc.; ii) JITS and not Apple is solely responsible for the Adia App; iii) Apple is not obliged in any way to provide maintenance and support services for the Adia App; iv) the user can notify Apple and Apple shall refund to the user any purchase price paid by the user for the Adia App if the Adia App fails to comply with a valid assurance; v) to the maximum extent permitted by applicable law, Apple bears no further warranty obligation with regard to the Adia App and, between JITS and Apple, all other claims, losses, liabilities, damages, costs or expenses attributable to non-compliance with an assurance shall be solely borne by JITS in accordance with the provisions of these terms of use; vi) JITS and not Apple is responsible for dealing with claims lodged by users or third parties in connection with the Adia App or the possession and/or use of the Adia App by users such as: a) product liability claims; b) claims that the Adia App violates prevailing statutory or regulatory requirements; c) claims under consumer protection law and similar legislation; vii) in the event of the assertion of claims by third parties due to the alleged violation of intellectual property rights by the Adia App or through the disposal of and use of the Adia App by a user, only JITS and not Apple is exclusively responsible in accordance with these terms of use for the investigation, defence, dispute resolution through settlement and discharge of such violation claims; viii) Apple and its subsidiaries are third parties to these terms of use and by consenting to these terms of use, users grant Apple and its subsidiaries the right (and Apple accepts this right) to enforce these terms of use against such users as third parties benefiting from these terms of use.
Users declare and guarantee that i) they are not in a country affected by a US government embargo or that is ranked by the US government as a country supported by terrorists; and ii) they are not included on a US government list of prohibited or restricted parties.
Users must comply with the applicable contractual conditions of third parties when using the Adia App. USE OF THE ADIA APP TAKES PLACE AT THE USER’S OWN RISK. DATA (INCLUDING LOCATION DATA) CAN BE INACCURATE.
11. Applicable law and place of jurisdiction
These terms of use are governed by Swiss substantive law.
The ordinary courts of the City of Zurich, Switzerland shall have exclusive jurisdiction for all claims or disputes arising out of or in connection with these terms of use.
12. Further provisions
Should individual provisions of these terms of use prove invalid, ineffective or unenforceable, this shall not affect or impair the validity or effectiveness of the other parts of these terms of use and the invalid part shall be replaced by a provision that reflects the mutual economic intent of both parties.
JITS is entitled to amend these terms of use at any time. It shall inform the users of changes in an appropriate manner. Should a user not consent to the amended terms of use, such user shall be required to notify JITS of this in writing within ten days following their publication, failing which the amended terms of use shall be deemed accepted. Continued use of Adia following the publication of the amended terms of use shall in all cases constitute their unreserved acceptance.

This privacy policy describes the manner in which and the reasons why we collect, process and use your personal data. It is important for us that you understand which personal data we collect and process, when and for what purpose we do this, how long we retain your personal data, who has access to them and which rights you have with regard to your personal data.

3. Personal data that we collect from you
When you use our services on the Adia online platform, we process various personal data that can be associated with you (“personal data”). We generally collect your personal data directly from you, e.g. upon Adia App registration, when providing our services to you or during interaction or communication with us. We can also obtain personal data from other sources such as third parties, public registers, media and the Internet in order to keep your information from publicly accessible sources fully up to date, for example.
In particular, we process the following personal data in the following situations and for the following purposes:
3.1. We process your personal data when you access the Adia App or use our services on the Adia online platform
For you to be able to register for the Adia App and use it and our services, we will process various personal data from you, in particular:

Information about candidates that is required for Adia registration. This particularly includes contact details, information about education and professional experience as well as language skills. The candidate can voluntarily provide further information (e.g. profile photo, copies of degree certificates etc.);

Information about candidates that is required for the issue and processing of the framework employment contract and assignment contracts. This particularly includes copies of IDs and work permits, bank account details, OASI number and further information required for registration with insurance schemes;

Information about clients and the client’s contact persons that is required for Adia registration as well as the issue and processing of hire contracts. This particularly includes information about the company, the contact person’s contact details and the VAT number;

Location data of the user;

Information and contents of the correspondence of users with the employees of JITS and other users, e.g. via contact forms and the chat tool integrated into Adia;

Other information entered by users via Adia or tools contained in Adia.
3.2. We process your personal data when you visit our website
We collect personal data during your visits to the https://adia.com website, including but not limited to data about data traffic and location data, data from weblogs, contents of surveys and contact forms and other communication data and information that you access. For example, this also includes technical data such as the time of access to our website, the duration of the visit, the pages retrieved and details about the device used (e.g. tablet, PC or mobile phone). Our collection of this personal data is intended to facilitate your future visits to the website by enabling us to propose contents to you that are relevant for you on the basis of the location from which you access the website.
JITS is entitled to collect information about the device used by the user, including the IP address, the operating system and the type of browser, for the purpose of system administration and to forward this information in aggregate form to advertising clients. These data comprise statistical data about users’ browsing activities and patterns and do not permit any identification of individual persons.
3.3. We use cookies
3.3.1. General information about cookies
We use cookies. Cookies are small text files that are stored on your device by your browser and facilitate the recording of specific data. We use our own cookies or standard third-party cookies common in the industry such as Google Analytics from Google Inc., USA. These cookies collect data anonymously; such data cannot be traced back to you unless you complete one of our forms, take part in a survey, subscribe to e-mail alerts or use other services that we offer on our website.
With the help of cookies, we can collect data about your online behaviour on our websites as well as the frequency of your visits to our websites. The cookies only allow our website to collect information about your visit to our website. 3.3.3. You can decline cookies
Users can decline the use of cookies by configuring their browser so that cookies cannot be saved on their device. All details will then be removed from the cookie. However, if users activate this setting, some parts of the website may not be able to be accessed or certain functions and services may not be able to be used. 3.3.4. Third-party cookies
Users are aware that the advertising clients of JITS and external providers of functions can also use cookies over which JITS has no control. JITS therefore recommends reviewing the websites of these external providers and their privacy policies for further details of their cookies and how users can control them.
For example, while visiting https://adia.com, you may come across third-party content such as a YouTube video and various Google maps. Furthermore, we offer you the option of communicating with us via social networks such as Facebook, Twitter, Instagram, YouTube, Snapchat or LinkedIn. We offer these contents so as to be able to provide you with up-to-date and carefully selected information that is relevant or of interest for you. However, this can also result in third parties outside our control storing additional cookies on your device. We therefore recommend that you view the privacy policies of these third parties on their websites. There you will find further information about their cookies and how you can manage these cookies.
The website may contain links to third-party websites. 3.4. We process your personal and telecommunications data for communication purposes
We process personal data if you contact us or we contact you, e.g. whenever you contact our customer services or write to or telephone us. We process your personal data in order to deal with and respond to your requests and questions. Generally speaking, data such as your name and contact details, date, time and contents, which might also contain personal data, are sufficient for communication. We process these data in order to provide you with information or notifications, process your request and communicate with you and for quality assurance and training purposes.
We collect information provided to us by you when you use our contact forms (such as “Contact” and “Send us a message”). The provision of your personal data via our contact forms is not legally or contractually required. However, please note that fields marked with an asterisk (*) are mandatory fields because we require this information in order to comply with or respond to your request. You may send us further information or personal data via our contact forms at your own discretion. Whenever you contact us, we store a record of this correspondence.
Whenever you use the chat function integrated in the Adia App, we process personal data that is deemed to constitute telecommunications data and could be subject to the obligation of secrecy under the Telecommunications Act, such as:

The content of communication between you and other users of the Adia App;

Marginal data (e.g. the fact that communication has taken place, the time when it took place and its duration);

Information about the geographical location from which a connection was established or the connection was forwarded;

We need to process these data in order to fulfil our contract with you. We are also obliged to process and retain the telecommunications data for the duration required to meet our statutory obligations (e.g. obligations pursuant to the Federal Act on the Surveillance of Post and Telecommunications (SPTA)).
You expressly consent to our processing and forwarding your telecommunications data to third parties for the purposes set out in this privacy policy that exceed the provision of telecommunications services (i.e. connection establishment, fulfilment of obligations pursuant to the Federal Act on the Surveillance of Post and Telecommunications, contract fulfilment).
3.5. We process your personal data for information and direct marketing purposes
We will only send you personal advertising and marketing communications if you have given us your consent to do so, unless we have received your contact details for the provision of our services and you have not declined the receipt of such marketing communications. You can register to receive marketing and advertising information by checking the applicable box on the form on which we collect your data.
B2B communication. If you represent our prospects, partners or clients, either prior to the conclusion of a contract with JITS or Adecco or during a business relationship between JITS and/or Adecco on the one hand and the legal entity represented by you on the other, we may process your basic contact details (e.g. first and last name, position, company name, e-mail address and telephone number) if this is necessary to conduct our joint business relationship. In this case, the processing of your personal data is based on our legitimate interest in fostering and developing our business relationship and our client base, the promotion of our products, services and client retention programmes. You cannot generally refuse this type of communication as it is not marketing-related but is required only for the respective business relationship.
You can opt out of receiving further marketing communications at any time without any problems. Simply click on the “Unsubscribe” function at the end of the e-mail. You can also exercise your right of revocation at any time by contacting us at support@adia.com and providing us with the following information: your name, your e-mail address, a telephone number, the marketing communication you no longer wish to receive.
3.6. Other purposes
Your personal data are also collected and processed by us in particular for the following purposes:

Customer service.

Provision, administration, backup and personalisation of websites, apps, online services and other infrastructure such as Wi-Fi.

Conclusion and execution of contracts with you.

Market research and opinion surveys. We may also forward your data for these purposes to third parties that conduct market research and opinion surveys on our behalf.

Remarketing. We may also use your data for the promotion of third-party products (such as products from other companies affiliated with JITS) or pass your data on to third parties (such as other companies affiliated with JITS) so that they can send you advertising themselves.

Corporate transactions. We also process personal data for the preparation and processing of corporate takeovers and sales and of purchases and sales of assets. We may disclose your personal data to a potential buyer if we intend to sell or transfer ownership or control of the company, assets, capital, transactions or services in part or in full to this buyer. If this sale is carried out, we will require the buyer to continue to comply with the conditions of this privacy policy. Should the sale not take place, we will require the third party not to make any use of or disclose your data and to delete them in full.

You are aware that the Adia App also makes use of the Google Maps app and other services and that your current location data may therefore be passed on to these services and stored by them for localisation purposes.

For creating the user profiles required for the use of Adia.

For bringing together candidates seeking temporary jobs with clients seeking temporary staff. To this end, the candidates' data are made available to clients and their contact persons and the clients' data and their contact persons are made available to candidates via Adia.

For assessing whether candidates are suitable for vacancies, in particular also by obtaining opinions and references about such clients.

For reviewing the creditworthiness of clients.

For issuing and processing the relevant contracts between JITS and candidates as well as JITS and clients.

4. Automated individual decision-making
“Automated individual decision-making” comprises decisions that are made automatically, i.e. without any relevant human influence, and which could have negative legal implications or other similarly negative consequences for you.
If you apply for jobs or assignments as a candidate online via the Adia online platform, we make automated individual decisions in order to check your suitability with regard to specific jobs advertised and to hire you on this basis. We also make automated individual decisions to verify your candidate profile. We obtain your consent to this automated individual decision-making in advance, that is, when you register on the Adia online platform.
5. Legal grounds
We generally use your personal data: i) to fulfil our contract, ii) with your explicit and informed consent where such consent is required by law (e.g. for newsletter dispatch), iii) to meet our statutory obligations and iv) for legitimate business interests such as the improvement of our services for you and in order to ensure optimum fulfilment of the contract concluded with you.
In particular, we process your data on the following legal grounds:

On the basis of contractual relationships between you and JITS;

Processing is necessary for our legitimate interests in the pursuit of the purposes set out above and these interests are not outweighed by your data protection interests;

We store your personal data as long as this is necessary for the purpose for which they have been collected and as long as we have a legitimate interest in the retention of personal data, for example for archiving purposes and IT security. We also store your personal data insofar and as long as this is required in accordance with a statutory retention obligation.
6. Data security
We use rigorous operational procedures and appropriate technical and organisational security measures to prevent unauthorised access to, changes, deletion or transmission of your personal data.
Although JITS does everything in its power to protect users’ data, the transmission of information via the Internet is not completely secure. If you share personal data via the Internet, you need to be aware that your data may be accessible to others and consequently may be collected and used by others without your consent. Your data can also get lost or be viewed by unauthorised parties during transmission. JITS is therefore unable to guarantee the security of personal data sent to JITS by users via Adia or in any other way; all data transmission takes place at the users’ own risk.
7. Disclosure of your personal data to third parties
Our employees, for example those in support areas such as IT, have access to your personal data.
We can also pass on your personal data to third parties that process the data on our behalf. We disclose your data to third parties in order to offer you our online platform, its contents and services, to support our efficient use of your data and to provide you with the contents and/or information.
In particular, we disclose your personal data to the following third parties:

To clients and their contact persons** receiving information about candidates via Adia.

To candidates** receiving information about clients and their contact persons via Adia.

To other branch offices of JITS and other companies affiliated with JITS**, including their suppliers, service providers and agents that are involved in the provision of the Adia online platform, its contents and the services offered via Adia.

To other companies of Adia or the Adecco Group** (i.e. companies affiliated directly or indirectly with Just in time staffing AG) that assist you and us in achieving the purposes set out above.

To other suppliers, contractors and representatives** that are involved in the provision of the Adia online platform, its contents and the services offered via Adia. This group of third parties includes, for example:

Future-Processing, responsible for “technical operations”; this supplier is located at Bojkowska 37A, 44-100 Gliwice, Poland.

Service providers ensuring the hosting of the platform and its contents;

Providers of specific functions that are made available via the Adia App, such as the provider of the chat tool integrated in the Adia App or the map displaying the place of work to candidates;

Other IT service providers;

Companies only have access to the personal data they require to carry out their tasks and these companies may not use such data for any other purposes.

To selected partner companies**: JITS is entitled to pass on the names and e-mail addresses of users to selected partner companies. These partner companies may send users information about their products and services. Users can at any time notify such partner companies directly that they no longer wish to receive further messages.

To government authorities or law enforcement agencies** should we discover at our sole discretion that we are legally obliged to do so.
8. Transmission of your personal data to countries outside Switzerland
We may send your personal data to recipients abroad and process them or have them processed there, including such countries that do not guarantee an equivalent level of data protection as that under Swiss law. If we send your personal data to these countries, we will take appropriate measures for the protection of your personal data, for example by obliging the recipient to consent to data processing agreements. These countries in particular include the United States of America and India.
9. How we store your personal data
We store your personal data as long as this is necessary for the purpose for which they have been collected and as long as we have a legitimate interest in the retention of personal data, for example for archiving purposes and IT security. We also store your personal data insofar and as long as this is required in accordance with a statutory retention obligation.
10. Your rights
According to the prevailing data protection provisions, you have the following rights:

Right to information and a copy of your personal data: You are entitled to request confirmation of whether we process your personal data. You are entitled to request detailed information about which personal data we have about you and how we process them, as well as a copy of your personal data. Right to be forgotten/deletion of your personal data: Under certain circumstances, you are entitled to the deletion of your personal data. You can submit such a request at any time and Adia will review whether your request can be granted. However, this right is subject to statutory rights and obligations that we may be under to store data. In those cases in which we conclude in accordance with prevailing law that your request for the deletion of your personal data must be granted, Adia will comply with it immediately.

Right of restriction or revocation concerning the processing of your data: Under certain circumstances, you are entitled to demand that the processing of your personal data be restricted or to object to its processing for reasons pertaining to your particular situation.
